Where we do so, we will notify you by email and explain the reason where practicable.

2 - Your Subscription and How It Works

  1. The Whisky Club operates an opt-out subscription model. By becoming a Member, you are automatically included in each month's purchase cycle unless you actively opt out within the timeframe described in clause 2.3. If you do not opt out, your nominated payment method will be charged and your whisky will be dispatched to your registered delivery address.
  2. The Club sends the Whisky of the Month email on the first Friday of each month. This email contains full details of the featured whisky including pricing and may also include other products available for purchase that month.
  3. The monthly opt-out window opens at 00:00:01am on the first Friday of each month and closes at 11:59:59pm on the following Sunday (a 72-hour period). The Club will also provide email notice of each upcoming opt-out window and charging date by email on the first Friday of each month. Where the opt-out window or charging date is varied due to a public holiday or operational requirement, the revised dates will be notified to Members via email at least 14 days in advance, and again on the first day of the 72-hour opt-out window. No variation will reduce the opt-out period below 72 hours. During this window you may:
    (a) opt out of that month's purchase;
    (b) purchase more than your standard subscription quantity (double-up); or
    (c) add other available products to your order.
    These actions can be completed via the link in the Whisky of the Month email or by logging into your account at www.thewhiskyclub.co.nz/my-account. Please contact us immediately if you are unable to access your account during the opt-out window.
  4. By becoming a Member, you agree to receive email communications from us, including the monthly Whisky of the Month email and transactional messages relating to your membership and orders. It is your responsibility to ensure that our email addresses (drams@mail.thewhiskyclub.co.nz and drams@thewhiskyclub.co.nz) are not blocked or filtered by your email provider. Instructions for ensuring deliverability are available in our Help Centre. The Club is not responsible for non-delivery of emails resulting from your email settings or service provider. By becoming a Member, you also consent to receiving commercial electronic messages from us, including promotional offers, product announcements and event invitations, in accordance with the Unsolicited Electronic Messages Act 2007 (NZ). You may withdraw this consent at any time by using the unsubscribe mechanism in any marketing email we send you or by contacting us as set out in our Privacy Policy.
  5. If you do not opt out during the window described in clause 2.3, your nominated payment method will be charged and your whisky will be delivered to your registered address. See Section 3 (Opt Outs and Refunds) for further detail.
  6. The price of the Whisky of the Month varies each month. Current pricing, inclusive of GST, is displayed in the Whisky of the Month email and on the Site. All prices are in New Zealand Dollars (NZD). Postage is charged at the flat rate displayed on the Site at the time of purchase. If you have been charged for an order, we will fulfil that order at the price confirmed at the time of purchase.
  7. All bottles are the distillery's standard bottle size as sold in New Zealand. In most cases this is 700ml. Where a bottle is a non-standard size, the size will be specified on the product page for that whisky.
  8. Unless otherwise stated, your nominated payment method will be charged on the first Monday following the first Friday of each month. The Club reserves the right to vary the timing of the monthly opt-out window and charging date where the standard schedule falls close to a public holiday period, including Christmas, New Year or Easter. Any variation will be reasonable in the circumstances and will be communicated to Members at least 14 days before the revised opt-out window or charging date takes effect.
  9. You may purchase additional products outside of the monthly opt-out window at any time by adding items to your cart via your account. Your nominated payment method will be charged at 11:30pm NZDT/NZST on the day you add items to your cart, and your order will be passed to our warehouse for dispatch the next business day. You may amend or remove items from your cart at any time before 11:30pm on the day of purchase.

3 - Opt-out, Refunds and Returns

  1. You are automatically included in each month's purchase cycle unless you actively opt out. To opt out, click the opt-out button in your account at https://thewhiskyclub.co.nz/my-account during the opt-out window which opens at 00:00:01am on the first Friday of each month and closes at 23:59:59 on the following Sunday, unless a different window has been notified to you in accordance with clause 2.3. ). TWC NZ reserves the right to vary the timing of the window and charging date around public holidays at its discretion and may, acting reasonably and taking into account the circumstances of the request and the status of the order, accept or decline late opt-out requests after the window closes. If a late opt-out is accepted after dispatch, we may require you will be required to return the bottle to be returned at your cost before a credit or refund is applied, provided we will consider alternative remedies where return would be unreasonable or disproportionately costly. Please contact us immediately if you are unable to access your account during the opt-out window.
  2. Upon successfully completing an opt-out, double-up or additional purchase, you will receive a confirmation email from drams@mail.thewhiskyclub.co.nz. You may also verify the status of your order by reviewing your order summary in your account. Opt-outs and double-ups reset at the start of each month, you must take action each month if you wish to opt out or double up.
  3. It is your responsibility to opt out within the opt-out window described in clause 2.3. There is no penalty for opting out. It is also your responsibility to ensure that your registered email address is current and that our email addresses are not blocked or filtered by your email provider, as set out in clause 2.4.
  4. We may, acting reasonably, accept a late opt-out request after the close of the opt-out window. Where a late opt-out is accepted:
    (a) if your order has not yet been processed, the amount charged will be credited to your account; and
    (b) if your order has already been processed and dispatched, we may require the bottle to be returned before a refund is provided, provided that we will consider alternative remedies where return of the product would be unreasonable or disproportionately costly. Where a return is required, we will clearly advise the return process and associated costs before the return is arranged.
    Requests for refunds or credits must be submitted within 30 days of the date of purchase. Postage costs are non-refundable for change-of-mind returns. Visit our Help Centre for further details.
  5. Nothing in clause 3.4 limits any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Where goods are faulty, not of acceptable quality (which does not include personal dissatisfaction with the taste, character or style of a whisky), or not as described, you may be entitled to a remedy under the Consumer Guarantees Act 1993 regardless of whether the opt-out window has closed or the 30-day period has elapsed. In such cases, please contact us at drams@thewhiskyclub.co.nz and we will arrange the appropriate remedy, which may include replacement, repair or refund. Where goods must be returned due to a fault or defect, we will cover reasonable return postage costs.

4 - Charging your card

  1. Successful transactions will be confirmed by tax invoice sent to your registered email address.
  2. We'll use every endeavour to fulfil your order, but we cannot guarantee your order if payment is declined. Following a declined payment we will notify you by email and we'll attempt to charge your payment method for the next five business days or until the relevant stock is sold out, whichever occurs first. Due to the very limited nature of our whiskies we reserve the right to reallocate your bottle(s) to waitlisted Members if your card remains declined after the final attempt. You will have an opportunity to update your payment details during this period. If you have saved more than one payment method, we reserve the right to attempt to charge any available payment method only for amounts that are due if your primary payment method is declined, and saving an additional payment method is deemed to authorise this practice. Our payment processor may receive updated card details, including expiry dates and card numbers, from your financial institution, and saving a payment method is deemed to authorise us to continue charging using updated details solely to process authorised payments received. We will provide clear and prominent notice of these Terms at onboarding in accordance with the Fair Trading Act 1986 and the Privacy Act 2020. It is your responsibility to ensure sufficient funds are available and to update your payment details before your current payment method expires.
  3. We endeavour to forecast and order sufficient Whisky of the Month stock to meet projected Member demand each month. Where demand exceeds available stock, stock will be allocated in the following order of priority: (a) double subscriptions; (b) single subscriptions, in order of longest-standing membership; and (c) double-up requests.
    On rare occasions this may mean that not all double-up requests are fulfilled, or that Members who have not opted out do not receive the Whisky of the Month. Where a payment is initially declined and the Whisky of the Month sells out before a subsequent payment attempt is successful, the Whisky of the Month will be removed from the Member's order automatically. If the Member has additional products in their order, only those additional products will be charged. Where possible, we will work with our suppliers to source additional stock for affected Members.
  4. Additional products available for purchase during the opt-out window are allocated on a strict first-come-first-served basis. Once available stock is depleted, Members may join a waiting list. If stock becomes available during the opt-out window, it will automatically be added to the Member's order and processed in accordance with clause 2.8.
  5. Where a Member Ballot is offered during the opt-out window, available stock is randomly allocated among Members who have entered the Ballot. Successful Members will be notified by email and their order processed in accordance with clause 2.8. If payment cannot be processed within a timeframe no less than 24 hours, and provided that Members have been clearly informed of the payment and re-attempt practices in accordance with  New Zealand law, the Ballot allocation may be reallocated to another eligible Member selected in accordance with the Ballot process, provided we have made reasonable attempts to contact you and process payment. This process continues until all available stock is exhausted and is subject to the opt-out subscription model and all applicable New Zealand consumer and privacy laws.
  6. Where a Member Ballot is offered outside the opt-out window, available stock is randomly allocated among Members who have entered the Ballot. Successful Members will be notified by email, and their order will be processed in accordance with the information in the confimation email, e.g. 'Successful ballot orders will be processed at 23:59pm on 10 September 2028". This process continues until all available stock is exhausted and is subject to these terms and all applicable New Zealand consumer and privacy laws.

5 - Delivery

  1. We, or our nominated delivery agents, will ship products to the delivery address registered in your account or otherwise nominated by you at the time of purchase. It is your responsibility to ensure your delivery address is current and accurate before each order is processed, as set out in clause 1.2.
  2. Postage and handling costs are charged at the flat rate displayed on the Site at the time of purchase and will be charged to your nominated payment method as part of your order total.
  3. If you do not receive your order within a reasonable time, please contact us. If an order has not been delivered, or has been delivered to an address other than your registered or nominated delivery address due to an error on our part, we will arrange a replacement shipment at no cost to you. Where a parcel is returned to our warehouse by the carrier (Return to Sender), we will contact you to confirm your delivery address and reship your order to the confirmed address upon receipt.
  4. If your order arrives damaged, please contact us as soon as reasonably practicable and in any event within 7 days of delivery. We will arrange a replacement and reserve the right to request photographic or other evidence of the damage before doing so.
  5. In accordance with the Sale and Supply of Alcohol Act 2012, all alcohol deliveries must be signed for by a person aged 18 years or older who is not under the influence of alcohol or drugs. If no eligible person is available to accept delivery, your order will be held at the nearest courier pickup point for collection. We recommend having your delivery sent to a workplace or other address where a suitable person will be available to sign for it during business hours.
  6. You must not request or permit a person under 18 years of age, or a person who is intoxicated, to accept delivery of any order placed with The Whisky Club. By placing an order, you confirm that the nominated recipient meets these requirements. Breach of this condition may result in termination of your Membership and may be reported to the relevant licensing authority.
  7. You may be required by our delivery partners to provide valid photo identification to confirm your age before receiving goods. Acceptable forms of identification are: (a) Kiwi Access Card; (b) valid New Zealand driver licence; (c) valid New Zealand or international passport; or (d) any other form of identification accepted under the Sale and Supply of Alcohol Act 2012.
  8. The Whisky Club holds New Zealand Off-Licence number 007/OFF/107/2025. All deliveries are made in compliance with the conditions of that licence and the Sale and Supply of Alcohol Act 2012.

  3. Payment for Gift Memberships may be made by the methods available at checkout at the time of purchase.
  4. The Gift Membership options available, and their current pricing, are set out on the gifting page at www.thewhiskyclub.co.nz/gifting. Where the monthly whisky price is less than the available credit balance, any remaining credit will be retained in the recipient's account for use against future purchases.

19 - Competition General Terms

  1. These General Competition Terms (General Terms) apply to all competitions, giveaways and promotional activities conducted by The Whisky Club New Zealand Ltd (NZ Company Number: 9429049284119) (The Whisky Club). Each competition is governed by these General Terms together with the specific Competition Brief for that promotion. In the event of any inconsistency between these General Terms and a Competition Brief, the Competition Brief prevails.
  2. Unless otherwise stated in the Competition Brief, entry is open to New Zealand residents aged 18 years or over who are current Members of The Whisky Club. Employees and immediate family members of The Whisky Club, its related entities and associated agencies are not eligible to enter. For this purpose, immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  3. Participation in any competition constitutes acceptance of these General Terms and the applicable Competition Brief. Information on how to enter and the prize description form part of the terms governing each competition.
  4. Entry must be made in accordance with the Competition Brief during the specified promotional period. Incomplete, indecipherable or late entries will be deemed invalid. Only one entry per person is permitted unless the Competition Brief expressly states otherwise. The use of automated entry software or any mechanical or electronic means to enter repeatedly is prohibited and will render all entries by that entrant invalid. Any costs associated with entering a competition, including internet access costs, are the entrant's responsibility.
  5. Unless otherwise stated in the Competition Brief, all competitions conducted by The Whisky Club are games of skill. Chance plays no part in determining winners. Entries are judged on the criteria specified in the Competition Brief.
  6. The Whisky Club reserves the right at any time to verify the validity of entries and entrants, including an entrant's identity, age and place of residence, where reasonably necessary to administer the competition or comply with law. The Whisky Club may disqualify an entrant where it reasonably determines that the entrant:
    (a) breaches these General Terms or the applicable Competition Brief;
    (b) provides false or misleading information;
    (c) tampers with the entry process; or
    (d) engages in unlawful or improper conduct calculated to jeopardise the fair conduct of the promotion.
    Errors and omissions may be accepted where doing so is fair and reasonable in the circumstances. Failure to enforce any right at any stage does not constitute a waiver of that right. If there is a dispute as to the identity of an entrant, The Whisky Club's determination is final.
  7. Winners will be selected and notified as specified in the Competition Brief. The Whisky Club's decision is final and no correspondence will be entered into. The Whisky Club reserves the right to select reserve winners in the event that an original winner is ineligible or unable to participate. Winners' details may be published on The Whisky Club's social media channels.
  8. Prizes are as specified in the Competition Brief. Prizes are non-transferable, non-exchangeable and cannot be taken as cash unless otherwise stated. If a winner does not claim or accept a prize (or any element of a prize) within the time stipulated in the Competition Brief, that prize or element may be forfeited after we have made reasonable attempts to contact the winner. We may require a winner to sign a release or acknowledgement that is reasonably necessary for the nature of the prize, participation in prize-related activities, or compliance with law, provided that it will not exclude or limit rights that cannot lawfully be excluded. The Whisky Club is not responsible for any prize element that is cancelled, delayed or otherwise affected by circumstances outside its reasonable control, but will use reasonable efforts to provide an equivalent substitute prize where practicable.
  9. Unless otherwise specified in the Competition Brief, prize winners agree to:
    (a) provide photographs and other content relating to their prize experience as reasonably requested by The Whisky Club; and
    (b) grant The Whisky Club permission to use their name, image, and prize-related content for promotional purposes on The Whisky Club's website, social media channels and other communications.
    Specific content obligations, including minimum quantities of photographs or videos, will be set out in the Competition Brief where applicable.
  10. Where an entry requires the submission of content including text, images, video or audio (Content), entrants agree that:
    (a) they are solely responsible for their Content, including its legality, originality and compliance with third party rights;
    (b) their Content will not be unlawful, fraudulent, defamatory, obscene, sexually inappropriate, violent, abusive, harassing, threatening, objectionable on grounds of race, religion, origin or gender, unsuitable for persons under 18 years of age, or otherwise unsuitable for publication;
    (c) their Content will not contain malicious code or cause harm to any person or entity;
    (d) they own or have obtained all necessary rights, licences and consents in respect of their Content, including from any person who appears in or has contributed to the Content; and
    (e) their Content does not infringe the intellectual property, privacy, publicity or other rights of any third party.
    The Whisky Club may amend, remove or decline to publish Content where reasonably necessary to comply with these Terms, protect rights or safety, address legal or reputational risk, or administer the competition fairly. Entrants agree to indemnify The Whisky Club against reasonable losses and liabilities arising directly from the entrant's breach of this clause.
  11. By entering a competition, each entrant grants The Whisky Club and its affiliates and sublicensees an unrestricted, royalty-free, perpetual, worldwide, irrevocable licence to use, reproduce, modify, adapt, publish and display their entry and Content for any purpose, including promotional, marketing and publicity purposes, in any media, without compensation or attribution. If requested by The Whisky Club, entrants agree to sign any further documentation required to give effect to this licence.
  12. To the extent permitted by law, each entrant unconditionally and irrevocably consents to any act or omission by The Whisky Club in relation to their Content that might otherwise infringe their moral rights under the Copyright Act 1994 (NZ), and warrants that they have full authority to grant this consent.
  13. If any outside act, event or circumstance prevents or significantly hinders The Whisky Club's ability to conduct a competition as described, including but not limited to technical failures, security or data breaches, fraud, vandalism, power failures, natural disasters, acts of God, civil unrest, strike, war or terrorism, The Whisky Club may in its absolute discretion modify, suspend, cancel or terminate the promotion, or recommence it on the same terms.
  14. To the extent permitted by law, The Whisky Club and its associated agencies, officers, employees and agents are not liable for loss, damage, injury or claim, including consequential loss, arising out of or in connection with:
    (a) participation in any competition or the entry or winner determination process;
    (b) acceptance, participation in or use of any prize or prize element;
    (c) late, lost, failed, delayed, inaccurate or misdirected entries or communications;
    (d) technical difficulties or equipment malfunction outside The Whisky Club's reasonable control;
    (e) theft, unauthorised access or third party interference outside The Whisky Club's reasonable control;
    (f) any variation in prize value from that stated in the Competition Brief;
    (g) any tax liability incurred by a winner or entrant; or
    (h) any broadcast, publication or statement made in connection with the promotion, except to the extent the loss, damage, injury or claim is caused by The Whisky Club's negligence, fraud, wilful misconduct or breach of a non-excludable obligation.
  15. Nothing in these General Terms limits, excludes or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded or limited (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, The Whisky Club excludes all liability as set out in clause 19.14.
  16. Entry details are collected by The Whisky Club for the purpose of conducting and administering the promotion, identifying and notifying winners, and related promotional and marketing purposes. The Whisky Club handles all personal information in accordance with its Privacy Policy available at www.thewhiskyclub.co.nz/terms-and-privacy. By entering, entrants consent to The Whisky Club and its related entities using their personal information to send information about products, services and promotions, and to The Whisky Club sharing their information with related entities, business partners and service providers for these purposes. Entrants may access, correct or make a complaint about their personal information as set out in the Privacy Policy. This includes consent to receive commercial electronic messages from The Whisky Club in accordance with the Unsolicited Electronic Messages Act 2007 (NZ). Entrants may unsubscribe from marketing communications at any time using the unsubscribe mechanism in any marketing email.
  17. The Whisky Club reserves the right to amend these General Terms and any Competition Brief where reasonably necessary to address legal requirements, operational issues, errors, prize availability, safety, fraud, misuse or other circumstances affecting the fair administration of a competition. We will not make a material change that disadvantages entrants after a competition has opened unless the change is reasonably necessary and, where practicable, entrants are notified and given a fair opportunity to withdraw or continue participating.
